The Federal Agency for Technical Regulations and Metrology (Rosstandart) has published clarifications concerning the issuance of documents on the conformity assessment of face masks, which are produced in accordance with technical requirements.
Previously there have been developed and registered technical regulations 13.92.29-005-00302178-2020 "Facial Hygienic Mask".
According to the requirements of the Federal Law No. 184-FZ of December 27, 2002, (art. 23), it is mandatory to carry out conformity assessment of products, only if it is specified in the technical reglement or GOST R system.
The problem lies in the fact that masks produced in accordance with these technical regulations do not qualify as an item of clothing or personal protective equipment. Normally they serve as a barrier to air filtration.
In this regard, face masks do not fall into the area of technical regulations TR CU 017/2011 "On the safety of light industry products" and TR CU 019/2011 "On the safety of personal protective equipment".
Therefore, face masks produced in accordance with technical regulations are not subjected to mandatory certification or declaration of conformity.
